The history

The origin of “Studio Varetti” goes back to the far 1926, when accountant Vittorio Varetti started to carry out the consultancy activity, founding the namesake firm in Lucca, at the ground floor of civic number 2 of “Piazza del Palazzo Dipinto”.  A square that at the time was the location of “the city”, where all the main professional firms had their headquarters: lawyers, engineers, technicians, accountants and notaries, all of proven and acknowledged experience.  Not far from there, by the way, all of the main bank institutions, the Tribunal, the Chamber of Commerce and, back then, also the Court of Appeal, were located.

Sulle frodi Iva nel mirino e-commerce e finte società

Lotta all'evasione. Nel mirino del Fisco sono finite le partite Iva per prevenire fenomeni di possibili illeciti. Più in generale le attenzioni riguardano le società fantasma (quelle apri e chiudi, per intenderci). Nel 2025 sono state più di 57 mila le posizioni stoppate di operatori a maggiore rischio. Quasi 7 partite Iva su dieci (il 69%) sono state chiuse, mentre solo 637 su 4.816 rappresentanti fiscali hanno presentato la dichiarazione sostitutiva e l'eventuale garanzia. Per colpire i finti operatori il Dlgs 13/2024 ha previsto una serie di paletti in merito all'esenzione Iva al momento dell'importazione della merce all'interno dell'Unione europea. In questa direzione va anche l'obbligo di una garanzia da 50 mila euro a carico degli operatori extra Ue che si avvalgono di rappresentanti fiscali per essere ammessi alla banca dati dei soggetti passivi che effettuano operazioni intracomunitarie. L'obbligo ha prodotto una tagliola per 2 mila partite Iva.

L'economia sociale vara il piano: fisco e finanze a misura d'uomo

Dal Consiglio dei ministri arriva il via libera, formale, al Piano d'azione nazionale per l'economia sociale. Si tratta di un documento programmatico e non un articolato normativo. Di fatto si sostanzia in una serie di indicazioni che saranno suscettibili di attuazione attraverso i veicoli legislativi ordinari. Per il comparto è un cambio di paradigma perché non viene più considerato come una costellazione di soggetti da trattare caso per caso, ma un ecosistema riconosciuto come tale, con una logica di funzionamento e un peso macroeconomico difficile da ignorare. Per la prima volta, il Paese si dota di una strategia organica per un settore sempre più rilevante nel sistema economico e sociale. L'elemento più significativo del documento è la perimetrazione dei soggetti dell'economia sociale italiana. Gratuità e mutualità restano gli elementi attorno a cui ruota anche la nuova fiscalità del Terzo settore.

Dalla Cassazione limiti all'efficacia del pignoramento presso terzi

Secondo l'orientamento più recente della Corte di cassazione, passati 60 giorni dalla notifica, il pignoramento presso terzi diventa automaticamente inefficace. Ne deriva che eventuali versamenti tardivi effettuati dal terzo pignorato in favore di Agenzia delle Entrate-Riscossione devono essere restituiti al contribuente. Nel caso fosse confermato anche in futuro, rischierebbe di rendere lo strumento del pignoramento presso terzi un'arma spuntata, proprio quando le ultime novità normative puntano ad un potenziamento dello strumento. Solo con l'autorizzazione del giudice è possibile andare oltre il termine.

Tassa rifiuti, il termine per chiedere il rimborso non parte dal pagamento

Il termine di 5 anni per chiedere il rimborso della Tari decorre dalla data di accertamento del diritto, con sentenza passata in giudicato, e non dalla data del pagamento. A confermarlo è la Corte di cassazione con l'ordinanza n. 20433/2026, che è stata originata da una controversia sulla tassa rifiuti ma ha stabilito un criterio interpretativo applicabile alla generalità dei tributi locali. Nel caso analizzato il contribuente aveva contestato la debenza della tassa rifiuti con riferimento a talune aree (asseritamente produttive di rifiuti speciali), promuovendo un contenzioso. I giudici del Palazzaccio hanno accolto le ragioni della parte privata, evidenziando che il termine per la richiesta di rimborso decorre dalla data del pagamento ovvero dal giorno in cui è stato definitivamente accertato il diritto alla restituzione.

Plusvalenze estere, tax credit se la sostitutiva è un obbligo

Con la sentenza n. 413/2026 la Cgt di Brescia ha stabilito che, nell'ambito della Convenzione Italia-Brasile, il credito d'imposta per le imposte pagate in Brasile sulle plusvalenze da cessione di partecipazioni spetta anche quando in Italia tali redditi sono assoggettati all'imposta sostitutiva del 26%, purché questa sia obbligatoria per legge. Secondo i giudici, l'esclusione del credito prevista dalla Convenzione riguarda solo i casi in cui il contribuente scelga volontariamente il regime sostitutivo. La decisione, in linea con i principi già affermati dalla Cassazione per i dividendi, estende tale orientamento anche alle plusvalenze e riconosce inoltre che la mancata indicazione del credito nella dichiarazione dei redditi non impedisce di ottenere il rimborso in sede contenziosa.

Il beneficiario non può liquidare in anticipo la propria quota del trust

Con l'ordinanza n. 12518 dello scorso 4 maggio, relativa al caso di un trust regolato dalla legge del Jersey, la Corte di cassazione ha escluso il 'diritto incondizionato' del singolo beneficiario di un trust alla devoluzione (liquidazione anticipata) della propria quota quando l'atto istitutivo fissa una durata del vincolo e prevede soltanto anticipazioni discrezionali. Il caso sul quale si sono pronunciati i giudici di legittimità trae origine dalla domanda di alcuni beneficiari di un trust della durata di 25 anni, nel quale era stata conferita una partecipazione societaria successivamente alienata dal trust. Dopo una prima distribuzione parziale di una somma di denaro per ciascun beneficiario, i ricorrenti avevano chiesto la liquidazione del residuo, incontrando il rifiuto del trustee e il dissenso di uno dei beneficiari.

Transizione 5.0, credito nell'anno dell'ok del Gse

In due Faq pubblicate sul proprio sito internet l'Agenzia delle Entrate ha chiarito che il credito d'imposta relativo a Transizione 5.0 e quello utilizzabile dai contribuenti c.d. 'esodati', per i quali la comunicazione del Gse è pervenuta nel 2026, dovranno essere dichiarati nel modello Redditi 2027 per il 2026, non essendo necessaria alcuna 'prenotazione' quest'anno nel modello relativo al 2025. L'Agenzia delle Entrate ha trattato il caso di un contribuente che ha effettuato investimenti agevolabili con il credito d'imposta Transizione 5.0, completandoli nel 2025. La comunicazione preventiva è stata trasmessa al Gse nel 2025, mentre quella di completamento del progetto è stata inviata nel 2026. Conseguentemente, la comunicazione del Gse, indicante l'importo del credito d'imposta effettivamente spettante, è stata ricevuta nel 2026.

Rottamazione 5, nuove rate

Come si legge sul sito dell'Agenzia delle Entrate-Rottamazione è on line e utilizzabile anche per la rottamazione 5 il servizio ContiTu che consente di scegliere gli avvisi/cartelle da pagare. I piani di pagamento della definizione agevolata sono quelli contenuti nella comunicazione delle somme dovute che il riscossore, in relazione alla rottamazione 5, ha inviato ai contribuenti nell'ultima settimana di giugno. Con ContiTu è possibile, dunque, rimodulare l'importo da corrispondere per singolo piano e richiedere i nuovi moduli di pagamento delle rate con gli importi aggiornati. Per fare questo, il contribuente dovrà indicare le cartelle/avvisi che intende pagare e il sistema ricalcolerà l'importo dovuto. Il servizio consente di ridefinire i piani, ma non il numero delle rate che resta quello indicato nella domanda di adesione presentata lo scorso 30 aprile.

Via libera del Garante privacy alla digitalizzazione del fisco. Nel 2025 l'Authority ha espresso parere favorevole ai principali provvedimenti delle Entrate: dall'estensione della dichiarazione dei redditi precompilata ai contribuenti forfettari, alle nuove modalità di consultazione delle spese sanitarie ai fini dei controlli fiscali, fino all'acquisizione nell'Anagrafe tributaria dei dati trasmessi dal Gestore dei servizi energetici. È quanto emerge dalla Relazione annuale 2025 del Garante per la protezione dei dati personali, presentata ieri alla Camera, che fotografa un anno di sostanziale via libera ai progetti di digitalizzazione del Fisco. L'unico rilievo riguarda un ammonimento dell'Ader per un episodio di comunicazione indebita di dati personali.

La Corte di cassazione, con l'ordinanza n. 7005/2026, ha escluso la prededucibilità del compenso di un professionista che aveva svolto attività per una domanda di concordato preventivo presentata davanti a un tribunale incompetente e poi riproposta presso un altro giudice.
